I am the vice president of a small condo association in Ohio. Our annual meeting is in February and we will have a secret ballot for the homeowners to elect Board members. There are a few items relating to rule changes that will also be addressed. The CC&R’s require a simple majority for a rule change. My question is do we put the proposed rule changes on the secret ballot or should they be put on the proxy that the homeowner signs to allow the election to take place?

Glen, you can allow all owners to vote by providing an absentee ballot, have an open vote at the meeting, or a secret ballot if you think it is necessary.

personally, i would recommend making sure the owners were aware of the rule change proposal before they assign their proxies. some may think "i am giving this proxy the right to vote for a board member", and then later find out they gave their proxy away to someone who doesnt agree with them on the proposed issue.

after all, we may agree that Terry is the best person for the board, but have opposite opinions on whether raising assessments is the best thing to do.
