There has been much controversy in our HOA concerning a "Ombudsman" position of a vendor making $85,800 annually. The board is split on the decision to continue or cancel his contract. We have a 5 member board, with just four members presently serving (two to two)

One of the board members that supports the ombudsman position has spearheaded a petition campaign to retain the ombudsman position. He has requested that owners sign this petition, which he and the ombudsman have circulated to owners. As well as posting it on our HOA website without other board members permission or knowledge.

Would it be unethical for him to be able to vote on this matter, or should he be requested to reccuse himself when the vote comes up?.

It sounds like it's a draw. Will the petition results change the BOD vote?

Why should he recuse just because his position is known and is seeking membership support to possibly sway another BOD member?

I'm not familiar with Ca. laws but if it is not illegal then it's just politics.

If it's illegal then the question is moot.
