I have posted a situation here on our HOA that was fairly well outlined.

Clubhouse use which usually is rented for personal use was being utilized and offered by our board to selected individuals for various reasons. One being a home based business owner looking to spread his business ( a friend and neighbor of our HOA president ) was given exclusive use of this room on two occasions, free of charge.

Recently in a group gather our HOA Pres could be over heard offering the clubhouse "free" for a fund raising event..........

Saying that, my request to host a local volunteer training program for hospice patients was turned down for various reasons. #1 they felt that the use of the cluhouse should be allowed for rental in the evening yet the home based business info session happened after work hours, mid week and weekend... I was told that the cluhouse since renovation may increase usage... it's been 2 months of emptyness and no rentals.. etc... the excuses essentially didn't make good good sense and rather showed favoritism, and HOA president descrepency according to who and whom was offered use of community facilities for "free".

I submitted a well written professional letter outlining the above with details, times etc. The last offer for comp use of facilities was easily heard by a group of witnesses and our Prez did this without proper vote etc of the BOD.

I was asking for no free rentals, consistency, and that even the board must rent and pay and sign docs just like the rest of the HOA members. That holding a key to the room by no way allows them power of selection or private use.

I asked to respond to my request. I was told by management i could of done this during open session... which i felt might of looked like an attack and made our board look bad...

What happens next?? I mean as far as response and what should I expect??

Discussion of this issue is not a cause for a closed session. Refer to the CA Davis-Stirling Act. Although I don't necessarily agree with their actions, if you thoroughly read your docs I'm sure you'll see that the BOD has the discretion to determine what the cluhbhouse will be used for. So what can you do now? Either let it go until such time as you want to rent the clubhouse or insist that they discuss the issue at the next regularly scheduled board meeting. Insist that the BOD put together a document that outlines the procedure for renting the clubhouse and perhaps ask that a committee be formed to oversee these rentals. Gather all your like-minded friends and neighbors for moral support at the meeting. The squeaky wheel gets the oil!

HI Mary, I did read our documents. There is nothing there about board discretion of use of facilities, however, we do have a rental agreement and a $50 fee that is required for all use. It's that simple.. but it doesn't seem to apply to the HOA BOD.

I also think I forgot to add.. the clubhouse is being used for FREE vs. using the rental agreement and fees per the BOD discretion specifically the Prez.. not that it matters.. I already submitted my letter.. will await a response.
