Our neighborhood was build in the early 60's. We had an active association for many years with a community pool & playground. When our neighborhood was established, no provision for mandatory dues was set up, it was voluntary only. When the neighborhood was young with many families with children that was no problem...but now it's older, no support existed and the pool/play area was removed. Some of us long time residents would like to begin a new association and I would like suggestions about how to go about it. Thanks, Rebecca - Little Rock, AR

You and other interested owners could call a meeting stating your desires and invite all owners to attend. If there is sufficient interest then elect a temporary Chairman and and a By-laws committee. Set a time for another meeting to approve the By-laws, elect officers, establish dues, and setup committees to help create the results desired - such as a social committee, an architectural committee, a covenant enforcement committee, a committee to look into ways to get services, such as trash collection at a group rate, etc.

The key is this sentence: "When our neighborhood was established, no provision for mandatory dues was set up, it was voluntary only." If there are no mandatory assessments tied to the land, you can only opt for starting another social club with voluntary dues. You can call it an HOA, but expectations of an Architectural Review Committee and covenant enforcement is ludicrous with a voluntary social club. Perhaps they can attempt to enforce rules with their members, but I would imagine their voluntary ranks would drop each time they did so. Good luck with your social club Rebecca. Harold
